Terms of Service
These Terms of Service (“Terms”) are the contract between you and inSave Hosting OÜ for the services you order on insave.hosting and in the client area at my.insave.hosting. By creating an account or placing an order you accept these Terms.
1. Who we are
inSave Hosting OÜ, a private limited company registered in Estonia (registry code 17479863, VAT number EE102976155), Kaupmehe tn 7-120, 10114 Tallinn, Estonia, e-mail [email protected] (“inSave”, “we”, “us”).
1.1 Payments to the Ukrainian sole proprietor
If you pay an invoice in Ukrainian hryvnia — by card through WayForPay or by bank transfer to a Ukrainian bank account named in the invoice — or in cryptocurrency through CoinPayments, the services covered by that invoice are provided by Fizychna osoba-pidpryiemets Horhul Ihor Serhiiovych (Ukrainian sole proprietor, taxpayer number 3418309473), who receives the payment, under the Public Offer, governed by Ukrainian law. For those services the Public Offer, not these Terms, is your contract; the Acceptable Use Policy, the Service Level Agreement and the Abuse procedure apply to you through the Public Offer. Services paid by any other method (card through Stripe, bank transfer in euro, cryptocurrency through CoinGate) are provided by inSave Hosting OÜ under these Terms.
1.2 Documents that form the contract
Your contract consists of these Terms, the Acceptable Use Policy, the Service Level Agreement, and the plan description shown on the product page and in the order at the time you place it. How we handle personal data is described in the Privacy Policy and the Cookie Policy. If the documents conflict, the order description prevails over these Terms, and these Terms prevail over the other documents.
2. Your account
2.1. You must be at least 18 years old and able to enter into contracts. If you order on behalf of a company, you confirm that you are authorised to bind it.
2.2. Give accurate and complete account details and keep them up to date. Use a contact e-mail address on a domain that is not hosted with us, so you still receive our messages if your hosting is unavailable.
2.3. To prevent fraud we may ask you to confirm your identity or payment method before we activate or continue a service. If you do not respond within 7 days, we may cancel the order and refund what you paid.
2.4. You are responsible for keeping your credentials secret and for everything done through your account. Use strong unique passwords and two-factor authentication where it is available, and tell us immediately if you suspect unauthorised access.
2.5. You confirm that you are not a person subject to sanctions of the European Union or the United Nations, and that you will not use the services in breach of sanctions or export-control rules that apply to us or to our payment providers.
3. The services
3.1. Each plan includes the resources, features and regions listed on its product page when you order. You choose the region at checkout where the plan offers a choice.
3.2. We operate and maintain the platform, apply security updates to the systems we manage, and keep the service running in line with the SLA. You are responsible for the content, applications and code you upload, for keeping your own applications (for example WordPress plugins and themes, unless your plan includes managed updates) up to date, and for the actions of your users and of any software or AI agent you run on the service.
3.3. We may improve or replace parts of the platform (software versions, hardware, data centre) as long as the service you pay for is not materially reduced during your paid billing period. We announce changes that need action from you in advance.
3.4. Free migration is a courtesy service: our engineers move your sites, databases and mail as described on the migration page. You remain responsible for keeping your own copy of the data at your previous provider until you have checked the result.
3.5. Managed services (server monitoring, VPS and dedicated server management, DevOps and SRE hours) are billed monthly with no minimum term. The scope, response times and included hours are those listed for the service at the time of order. Unused DevOps and SRE hours carry over for one month and then expire; all unused hours, including carried-over ones, expire when the service is cancelled. After a managed service ends, the backups we made under it are kept for 30 days and then deleted.
4. Acceptable use
You must follow the Acceptable Use Policy. It lists what may not be hosted or done on our network and how fair use of shared resources works. Breaching it may lead to suspension or termination under section 9.
5. Prices, invoices and renewal
5.1. Services are paid in advance for the billing cycle you choose. Prices are shown in USD, EUR or UAH; the currency of your client account is set when you open it.
5.2. Prices exclude VAT. We add VAT where the law requires it: Estonian VAT for customers in Estonia, VAT of your country for consumers elsewhere in the EU, and no VAT (reverse charge) for EU businesses with a valid VAT number entered in the account.
5.3. Services renew automatically for the same billing cycle until you cancel. We issue the renewal invoice 10 days before the due date. You can change the billing cycle or cancel in the client area at any time.
5.4. A plan renews at the price you bought it at. If we change the price of a plan, the new price applies to new orders. If we ever need to change the price of an existing service, we will tell you in advance by e-mail and you may cancel before the change takes effect.
5.5. If an invoice is not paid by its due date, the service is suspended. A service that remains unpaid 30 days after the due date is terminated and its data is deleted (see section 9.4). Domain names are handled as described in section 8.
6. Refunds and money-back guarantee
6.1. For the first order of a service you can cancel and get a full refund of the plan price within:
| Service | Money-back period |
|---|---|
| Shared hosting, Managed WordPress | 30 days |
| Reseller hosting | 90 days, if fewer than 20% of the plan’s client accounts have been created |
| VPS, OpenClaw hosting | 14 days |
| Dedicated servers | not refundable |
| Domain names, SSL certificates, setup fees | not refundable once registered, issued or incurred |
6.2. The money-back guarantee applies once per customer and per service type. It does not apply to renewals, to upgrades, or to services suspended or terminated for breach of these Terms or the Acceptable Use Policy.
6.3. Refunds go back to the original payment method. If that is not possible (for example, a cryptocurrency payment), we refund by bank transfer or as account credit, at your choice.
6.4. After the money-back period ends, you can cancel a service at any time and get back the unused part of the price paid for the current billing cycle, in proportion to the number of days left until the end of that cycle. Setup fees and the price of domain names, SSL certificates and licences are not refunded. We add the refund to your account balance straight away; if you ask for it to be paid out instead, we refund it as described in section 6.3 after checking the request. This section does not apply to dedicated servers of any line, custom solutions (services configured or priced individually for you), managed services, or services suspended or terminated for breach of these Terms or the Acceptable Use Policy: for them, cancelling ends the service at the end of the paid billing cycle and payments for the current cycle are not refunded, except where the law or section 6.5 gives you a right to a refund.
6.5. Consumers in the European Economic Area have a statutory right to withdraw from a distance contract within 14 days without giving a reason. When you order, you ask us to start the service immediately. If you withdraw within 14 days, we refund what you paid less the value of the service provided up to the withdrawal, in proportion to the full price. Where the law excludes or limits the right of withdrawal (for example, once a domain name has been registered in your name), the statutory right applies only to that extent. Our money-back periods in section 6.1 come in addition to this right and never reduce it.
7. Availability and support
7.1. We target 99.9% monthly availability for hosting plans. How availability is measured and the service credits you get if we miss it are set out in the Service Level Agreement.
7.2. Support is provided through tickets in the client area, which you can open at any time. Response targets for managed services are part of their plan description.
7.3. We take backups as described for your plan and store them in a different country from the primary data. Backups are a safety net, not a replacement for your own copies: keep your own backups of data that matters to you.
8. Domain names
8.1. We are a reseller. Domain names are registered through Openprovider (Hosting Concepts B.V., the Netherlands) as registrar, with the registry of each domain extension. We are not an ICANN-accredited registrar. You can look up the sponsoring registrar of any domain at lookup.icann.org.
8.2. You must give accurate registrant contact details and update them within 7 days of any change. Deliberately false details, failure to update them, or not answering a request to confirm them within 15 days is a material breach and may lead to suspension or cancellation of the domain.
8.3. To register a domain we pass the registrant details to the registrar and the registry. They process the data to register and maintain the domain, publish registration data where the registry rules require it, and comply with ICANN policies. If you provide data of other people (for example, an administrative contact), you confirm they have been informed and agree.
8.4. You confirm that, to your best knowledge, registering and using the domain does not infringe the rights of others. Domain registrations are subject to the rules of the registry and of ICANN, including the Uniform Domain-Name Dispute-Resolution Policy, the Uniform Rapid Suspension procedure and the Transfer Dispute Resolution Policy, and may be suspended, cancelled or transferred to correct an error or to resolve a dispute. You agree to indemnify the registrar and registry against claims arising from your registration or use of the domain.
8.5. Domains renew automatically if auto-renewal is on and the renewal invoice is paid before expiry. If it is not paid, the domain expires and enters the registry’s grace and redemption periods, during which restoring it may cost extra; after that it is deleted and becomes available to others. Premium domains may have higher registration and renewal prices.
8.6. You can transfer a domain to another provider at any time. We provide the authorisation code and unlock the domain within 5 calendar days of your request, except where a registry rule or a court order prevents it.
8.7. Your rights and responsibilities as a registrant are summarised by ICANN in Registrants’ Benefits and Responsibilities. The registrar’s own terms are published at openprovider.com.
9. Suspension and termination
9.1. We may suspend a service, fully or partly, if:
- an invoice is overdue (section 5.5);
- your account details are false or you do not complete a verification request;
- the service breaches the Acceptable Use Policy or the law, or we receive a substantiated notice about illegal content (see the Abuse procedure);
- the service threatens the security or stability of our network or other customers, for example because it is compromised, sends spam or is under an attack we cannot otherwise contain;
- a court, authority or registry requires it.
9.2. Where possible we contact you first and give you a reasonable time to fix the problem. We act without prior notice when there is an immediate risk to people, data or the network, or when the law does not allow us to warn you. When we restrict a service because of its content, we tell you the reasons and how to respond.
9.3. We may terminate the contract if a breach is serious or repeated, or if a suspension reason is not fixed within 14 days. You may terminate at any time by cancelling the service in the client area.
9.4. When a service is terminated, its data and backups are deleted on our normal rotation and cannot be restored. Download what you need before cancelling or before an unpaid service reaches its termination date.
9.5. If we stop offering a service, we give you at least 30 days’ notice and refund the unused part of any prepaid period.
10. Liability
10.1. Our total liability for all claims connected with a service in any 12-month period is limited to the amount you paid for that service in that period. Service credits under the SLA count towards this limit.
10.2. We are not liable for indirect or consequential loss, such as lost profit, revenue or business opportunities, or for loss of data you could have avoided by keeping your own backups.
10.3. These limits do not apply to damage caused intentionally or by gross negligence, to death or personal injury, or to any liability that cannot be limited by law. If you are a consumer, nothing in these Terms limits the rights mandatory consumer law gives you.
10.4. You are liable for, and will compensate us for, losses and third-party claims caused by content or software you host, or by your breach of these Terms or the Acceptable Use Policy.
11. Force majeure
Neither party is liable for failing to perform because of events beyond its reasonable control, such as natural disasters, war, acts of authorities, large-scale network or power failures, or attacks that exceed reasonable protection. The affected party informs the other without undue delay and resumes performance as soon as possible.
12. Changes to these Terms
We may update these Terms. We tell you about material changes by e-mail at least 30 days before they take effect. If you do not agree, you can cancel before that date and we refund the unused part of any prepaid period. Changes required by law, or that only benefit you, may take effect sooner.
13. Governing law and disputes
13.1. These Terms are governed by the laws of Estonia.
13.2. Disputes with business customers are resolved by Harju County Court (Harju Maakohus) in Tallinn.
13.3. If you are a consumer, you keep the protection of the mandatory consumer law of your country of residence and may bring a claim in the courts of that country. Before going to court you may contact the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon) at the Consumer Protection and Technical Regulatory Authority.
